Clackamas Education Service District is committed to providing a safe, inviting and respectful learning environment. We want everyone, our families, students and our staff, to feel that they are valued members of our diverse community. Changes in federal enforcement of immigration policy have raised concerns about legal immigration status among some people in our community. In our continuing effort to provide safe and supportive environments for learning, we are sharing the following information.
Our Nondiscrimination Policy States that: Clackamas Education Service District shall promote nondiscrimination and an environment free of harassment based on an individual’s race, color, religion, sex, sexual orientation, national origin, disability, marital status, or age or because of the race, color, religion, sex, sexual orientation, national origin, disability, marital status, or age of any other persons with whom the individual associates.
Free public education: Oregon law (ORS 339.115) affirms that all children are entitled to a free public K-12 education, regardless of their immigration status. Clackamas Education Service District does not ask about or know the citizenship status of its students or families, and does not report it.
Privacy rights and protocol: The Family Educational Rights and Privacy Act (FERPA) protects your child’s educational record, which means the district is prohibited from sharing information with third parties. Students are not questioned without legal cause and the awareness of their parents. If law enforcement officials enter a school, they are required to show credentials and provide a purpose for their presence.
Limitations on Department of Homeland Security (DHS) Enforcement Action: Detailed information from the DHS and the U.S. Department of Education is available at: https://www.cbp.gov/border-security/sensitive-locations-faqs. In general, DHS has explained that immigration enforcement actions may not occur at or in “sensitive locations.” These locations include:
- Schools, such as known and licensed daycares, pre-schools and other early learning programs; primary schools; secondary schools; post-secondary schools up to and including colleges and universities; as well as scholastic or education-related activities or events.
- School bus stops that are marked and/or known to the officer, during periods when children are present at the stop.
- Medical treatment and health care facilities,such as hospitals, doctors’ offices, accredited health clinics, and emergent or urgent care facilities.
- Places of worship,such as churches, synagogues, mosques, and temples.
- Religious or civil ceremonies or observances, such as funerals and weddings.
- During public demonstrations, such as a march, rally, or parade.
If your children are experiencing anxiety or stress, please inform the teacher or program director. Our staff can help to reassure students and families about their concerns. In the event of emergencies, be sure that your child’s emergency contact information is up to date.
